Gov. Newsom's Executive Order

Gov. Newsom announced a statewide Executive Order for people to stay at home . The directive went into effect on March 19th. It was mentioned that 21.3 million Californians are currently already living under similar shelter at home guidance.

Notably, the Executive Order references the guidance issued earlier today by Cybersecurity and Infrastructure Security Agency (CISA) within the U.S. Department of Homeland Security with an initial list of “Essential Critical Infrastructure Workers.”

In speaking about enforcement of this order, Newsom noted a social contract and social pressure to help Californians “meet the moment” to protect themselves, their families, and the broader community. Newsom said that the state is looking at a hospitalization rate of 20 percent for acute care, which amounts to 19,543 people that would need to be hospitalized above the existing capacity of California’s system.

The Franchise Tax Board (FTB) extended the filing and payment deadline for all California taxpayers until July 15, 2020, due to COVID-19.

Gov. Cuomo's Executive Order

No. 202.7: Continuing Temporary Suspension and Modification of Laws Relating to the Disaster Emergency. Effective March 21, 2020 at 8 p.m. and until further notice all businesses and not-for-profit entities in the state shall utilize, to the maximum extent possible, any telecommuting or work from home procedures that they can safely utilize. Each employer shall reduce the in-person workforce at any work locations by 75% no later than March 21 at 8 p.m. Any essential business or entity providing essential services or functions shall not be subject to the in-person restrictions.

Colorado
Gov. Polis Executive Order and Public Health Order

Governor Polis announced a number of state actions to address the impact of COVID-19. Actions include a special enrollment period for uninsured Coloradans, executive orders temporarily suspending elective surgeries and reducing in-person contact related to election requirements, and an updated public health order from the Colorado Department of Public Health and Environment.

In addition, the Colorado Department of Public Health and Environment issued an updated public health order closing bars, restaurants, theaters, gyms and casinos to include nonessential personal services facilities, horse track and off-track betting facilities statewide. Nonessential personal services include hair or nail salons, spas, or tattoo or massage parlors.

Gov. Whitmer's Executive Order, Temporary Prohibition on Large Assemblages and Events
Temporary prohibition on large assemblages and events, temporary school closures

The novel coronavirus (COVID-19) is a respiratory disease that can result in serious illness or death. It is caused by a new strain of coronavirus not previously identified in humans and easily spread from person to person. There is currently no approved vaccine or antiviral treatment for this disease.

On March 10, 2020, the Michigan Department of Health and Human Services identified the first two presumptive-positive cases of COVID-19 in Michigan. On that same day, I issued Executive Order 2020-4. This order declared a state of emergency across the state of Michigan under section 1 of article 5 of the Michigan Constitution of 1963, the Emergency Management Act, 1976 PA 390, as amended, MCL 30.401-.421, and the Emergency Powers of the Governor Act of 1945, 1945 PA 302, as amended, MCL 10.31-.33.

The Emergency Management Act vests the governor with broad powers and duties to “cop[e] with dangers to this state or the people of this state presented by a disaster or emergency,” which the governor may implement through “executive orders, proclamations, and directives having the force and effect of law.” MCL 30.403(1)-(2). Similarly, the Emergency Powers of the Governor Act of 1945, provides that, after declaring a state of emergency, “the governor may promulgate reasonable orders, rules, and regulations as he or she considers necessary to protect life and property or to bring the emergency situation within the affected area under control.” MCL 10.31(1).

To mitigate the spread of COVID-19 and to provide essential protections to vulnerable Michiganders and this state’s health care system and other critical infrastructure, it is reasonable and necessary to impose limited and temporary restrictions on large events and assemblages of people.

Acting under the Michigan Constitution of 1963 and Michigan law, I order the following:

  1. Beginning on March 13, 2020 at 5:00 pm, and continuing through April 5, 2020 at 5:00 pm, all assemblages of more than 250 people in a single shared space and all events of more than 250 people are prohibited in this state, except for assemblages for the purpose of: industrial or manufacturing work; mass transit; or the purchase of groceries or consumer goods. A single shared space includes but is not limited to a room, hall, cafeteria, auditorium, theater, or gallery. This prohibition does not abridge protections guaranteed by the state or federal constitution under these emergency circumstances.
  2. Beginning on March 16, 2020, all elementary school buildings and secondary school buildings in this state must close to students for educational purposes through April 5, 2020. This requirement includes all public, nonpublic, and boarding schools in the state. This requirement does not apply to residential facilities at schools and childcare providers at schools.
  3. Consistent with MCL 10.33 and MCL 30.405(3), a willful violation of this order shall constitute a misdemeanor.

Gov. Pritzker's Executive Order Closing Down Non-Essential Businesses

Governor Pritzker issued a statewide “Shelter in place” executive order (EO). This EO goes into effect on March 21, 2020, and will be in place through April 7, 2020.

This EO closes down non-essential businesses and operations. All places of public amusement, whether indoors or outdoors, including but not limited to, locations with amusement rides, carnivals, amusement parks, water parks, aquariums, zoos, museums, arcades, fairs, children’s play centers, playgrounds, funplexes, theme parks, bowling alleys, movie and other theaters, concert and music halls, and country clubs or social clubs shall be closed to the public.

All travel, including, but not limited to, travel by automobile, motorcycle, scooter, bicycle, train, plane, or public transit, except Essential Travel and Essential Activities as defined below, is prohibited. People riding on public transit must comply with Social Distancing Requirements to the greatest extent feasible. This Order allows travel into or out of the State to maintain Essential Businesses and Operations and Minimum Basic Operations.

This EO will be enforced by local and state police pursuant to inter alia, Section 7, Section 18, and Section 19 of the Illinois Emergency Management Agency Act, 20 ILCS 3305.

I also think it’s important to highlight “essential businesses and operations” within this EO.

1. Essential Businesses and Operations. For the purposes of this Order, “Essential Businesses and Operations” means Healthcare and Public Health Operations, Human Services Operations, Essential Governmental Functions, and Essential Infrastructure, and the following.


  • a. Stores that sell groceries. Grocery stores, certified farmers’ markets, farm and produce stands, supermarkets, convenience stores, and other establishments engaged in the retail sale of groceries, canned food, dry goods, frozen foods, fresh fruits and vegetables, pet supplies, fresh meats, fish, and poultry, alcoholic and non-alcoholic beverages, and any other household consumer products (such as cleaning and personal care products). This includes stores that sell groceries and also sell other non-grocery products, and products necessary to maintaining the safety, sanitation, and essential operation of residences;
  • b.Food, beverage, and cannabis production and agriculture. Food and beverage manufacturing, production, processing, and cultivation, including farming, livestock, fishing, baking, and other production agriculture, including cultivation, marketing, production, and distribution of animals and goods for consumption; licensed medical and adult use cannabis dispensaries and licensed cannabis cultivation centers; and businesses that provide food, shelter, and other necessities of life for animals, including animal shelters, rescues, shelters, kennels, and adoption facilities;
  • c. Organizations that provide charitable and social services. Businesses and religious and secular nonprofit organizations, including food banks, when providing food, shelter, and social services, and other necessities of life for economically disadvantaged or otherwise needy individuals, individuals who need assistance as a result of this emergency, and people with disabilities;
  • d. Media. Newspapers, television, radio, and other media services;
  • e. Gas stations and businesses needed for transportation. Gas stations and auto-supply, auto-repair, and related facilities and bicycle shops and related facilities;
  • f. Financial institutions. Banks, currency exchanges, consumer lenders, including but not limited, to payday lenders, pawnbrokers, consumer installment lenders and sales finance lenders, credit unions, appraisers, title companies, financial markets, trading and futures exchanges, affiliates of financial institutions, entities that issue bonds, related financial institutions and institutions selling financial products;
  • g. Hardware and supply stores. Hardware stores and businesses that sell electrical, plumbing, and heating material;
  • h. Critical trades. Building and Construction Tradesmen and Tradeswomen, plumbers, electricians, exterminators, cleaning and janitorial staff for commercial and governmental properties, security staff, operating engineers, HVAC, moving and relocation services, and other service providers who provide services that are necessary to maintaining the safety, sanitation, and essential operation of residences, Essential Activities, and Essential Businesses and Operations;
  • i. Mail, post, shipping, logistics, delivery, and pick-up services. Post offices and other businesses that provide shipping and delivery services, and businesses that ship or deliver groceries, food, alcoholic and non-alcoholic beverages, goods or services directly to residences or through commercial channels;
  • j. Educational institutions. Educational institutions—including public and private K-12 schools, colleges, and universities—for purposes of facilitating distance learning, performing critical research, or performing essential functions, provided that social distancing of six-feet per person is maintained to the greatest extent possible. This Order is consistent with and does not amend or supersede Executive Order 2020-05 (COVID-19 Executive Order No. 3) or Executive Order 2020-06 (COVID-19 Executive Order No. 4) except that affected schools are ordered closed through April 7, 2020.
  • k. Laundry services. Laundromats, dry cleaners, industrial laundry services, and laundry service providers;
  • l. Restaurants for consumption off-premises. Restaurants and other facilities that prepare and serve food, but only for consumption off-premises, through such means as in-house delivery, third-party delivery, drive-through, curbside pick-up, and carry-out. Schools and other entities that typically provide food services to students or members of the public may continue to do so under this Order on the condition that the food is provided to students or members of the public on a pick-up and takeaway basis only. Schools and other entities that provide food services under this exemption shall not permit the food to be eaten at the site where it is provided, or at any other gathering site due to the virus’s propensity to physically impact property. This Order is consistent with and does not amend or supersede Section 1 of Executive Order 2020-07 (COVID-19 Executive Order No. 5) except that Section 1 is ordered to be extended through April 7, 2020;
  • m. Supplies to work from home. Businesses that sell, manufacture, or supply products needed for people to work from home;
  • n. Supplies for Essential Businesses and Operations. Businesses that sell, manufacture, or supply other Essential Businesses and Operations with the support or materials necessary to operate, including computers, telecommunications equipment, audio and video electronics, household appliances; IT and telecommunication equipment; hardware, paint, flat glass; electrical, plumbing and heating material; sanitary equipment; personal hygiene products; food, food additives, ingredients and components; medication not requiring a medical prescription; medical and orthopedic equipment; optics and photography equipment; diagnostics, food and beverages, chemicals, and soaps and detergent;
  • o. Transportation. Airlines, taxis, transportation network providers (such as Uber and Lyft), vehicle rental services, and other private, public, and commercial transportation and logistics providers necessary for Essential Activities and other purposes expressly authorized in this Order;
  • p. Home-based care and services. Home-based care for adults, seniors, children, and/or people with developmental disabilities, intellectual disabilities, substance use disorders, and/or mental illness, including caregivers such as nannies who may travel to the child’s home to provide care, and other in-home services including meal delivery;
  • q. Residential facilities and shelters. Residential facilities and shelters for adults, seniors, children, and/or people with developmental disabilities, intellectual disabilities, substance use disorders, and/or mental illness;
  • r. Professional services. Professional services, such as legal services, accounting services, insurance services, real estate services (including appraisal and title services);
  • s. Day care centers for employees exempted by this Order. Day care centers granted an emergency license pursuant to Title 89, Section 407.400 of the Illinois Administrative Code, governing Emergency Day Care Programs for children of employees exempted by this Order to work as permitted. The licensing requirements for day care homes pursuant to Section 4 of the Child Care Act, 225 ILCS 10/4, are hereby suspended for family homes that receive up to 6 children for the duration of the Gubernatorial Disaster Proclamation.
  • t. Manufacture, distribution, and supply chain for critical products and industries. Manufacturing companies, distributors, and supply chain companies producing and supplying essential products and services in and for industries such as pharmaceutical, technology, biotechnology, healthcare, chemicals and sanitization, waste pickup and disposal, agriculture, food and beverage, transportation, energy, steel and steel products, petroleum and fuel, mining, construction, national defense, communications, as well as products used by other Essential Businesses and Operations.
  • u. Critical labor union functions. Labor Union essential activities including the administration of health and welfare funds and personnel checking on the well-being and safety of members providing services in Essential Businesses and Operations – provided that these checks should be done by telephone or remotely where possible.
  • v. Hotels and motels. Hotels and motels, to the extent used for lodging and delivery or carry-out food services.
  • w. Funeral services. Funeral, mortuary, cremation, burial, cemetery, and related services.

Gov. Sisolak's Emergency Order Closing Non-Essential Businesses
Governor Sisolak announces new directive for nonessential businesses

Las Vegas, NV — Today, Governor Steve Sisolak signed a new emergency directive to order non-essential businesses to close. This is the third directive he has signed since declaring a state of emergency. This is follow-up measure to Nevada Health Response COVID-19 Risk Mitigation Initiative, which the governor announced on Tuesday, March 17.“ Previously, I asked non-essential businesses to close their doors to the public. I am no longer asking them to do that,” said Gov. Sisolak. “I am directing all non-essential businesses to close. I repeat. If you are NOT an essential business, I am using my power as Governor under an emergency declaration to order you to close. I am signing a new emergency directive, the third I’ve signed since declaring a state of emergency.
